It's a nuanced issue. You are legally required to run the ad to hire a foreign worker in many cases.

This legal requirement is made by the laws of the US. They should change the laws so employers do not have to run the ad to hire a foreign worker, if this was done, the employers would stop running the ads and hire the foreign worker without the ad.

There are a lot of reasons you might want to hire a foreign worker domestically. In many instances, you may just be arbitrarily going through the legal motions to do something, which you desire to do for perfectly legitimate business reasons besides profitability, but the impediment is made by the laws.

Most job hires happen domestically by word of mouth and knowing someone on the inside of a business. Since this is so, why would an employer have to have an ad to hire a foreign worker, then they don't usually run ads for domestic workers? It's silly.

The job market is not a 100% public market, where it is open to all individuals for consideration. Most hires happen outside public knowledge and it's not discrimination but just the natural behavior of people hiring those they can trust in their circle of acquaintances.

As someone who works in Microsoft town, I can attest to this.

As it is now, Indians on H1B make up the majority of the employees at Microsoft. The only people who can afford to live in this city work at Microsoft. The white people who were born and grew up here are being driven out.

In a few years, once the children of the H1B's grow up, nationals will be in the very small minority.
